El 23 de marzo de 2011 la Comisión aprobó el Informe de Fondo No. 23/11 en el cual concluyó que Chile era responsable de la violación de los derechos a las garantías judiciales, a la protección judicial y a la integridad personal, en conjunción con la obligación general de garantizar los derechos humanos, así como el deber de adecuar la legislación interna en perjuicio del señor García Lucero y su familia por la falta de investigación y reparación integral de los actos de tortura cometidos contra el señor García Lucero.
